UPDATE: Distracted driving is rapidly becoming a serious concern in Durango, Colorado, following a recent accident involving a pickup truck and a locomotive.
On Monday, a driver admitted to being distracted when their vehicle collided with a Durango & Silverton Narrow Gauge Railroad train. This incident highlights a troubling trend since the state’s new hands-free driving law took effect on January 1, 2023. Despite the law’s enforcement, local drivers appear to be more distracted than ever.
The Colorado Hands-Free Law prohibits all cellphone use while driving, including texting, holding a phone, or using speakerphone. Yet, enforcement remains challenging. The Durango Police Department confirmed they have issued only four citations for hands-free violations this year, with three of those linked to crashes involving careless driving.
Durango Police Department spokespeople clarified that the hands-free law is a secondary offense. Officers cannot pull over a driver solely for using their cellphone; they must first witness a primary violation, like speeding.
Across Colorado, the Colorado State Patrol reports a staggering 498 citations for hands-free violations on highways, illustrating a statewide issue. Trooper Gabriel Moltrer stated, “Law enforcement can pull over drivers if an officer witnesses an individual driving carelessly while holding a device.”
To avoid the potential $75 fine and two license suspension points for first-time offenders, drivers are encouraged to use hands-free accessories such as Bluetooth headsets or car mounts. Importantly, the law does not apply to those reporting emergencies.
“Every life in our community matters – and that’s what drives our approach to traffic safety,” said McKenzie Perdue of the DPD. “Distracted driving can change lives forever. Our role is to help prevent that.”
