
The Department of Homeland Security (DHS) announced on Monday that it will not comply with California’s newly enacted law prohibiting agents from wearing masks during enforcement operations. This decision comes shortly after California Governor Gavin Newsom signed the legislation, which aims to enhance transparency and accountability for law enforcement agencies.
DHS criticized the law as unconstitutional, stating, “To be clear: We will NOT comply with Governor Newsom’s unconstitutional mask ban.” The agency emphasized that masks serve as crucial protection for U.S. Immigration and Customs Enforcement (ICE) agents, particularly given the alarming rise in attacks against them. DHS reported a staggering 1,000% increase in assaults on its personnel in recent months, prompting concerns for their safety and that of their families.
During a speech at a local high school, Newsom defended the legislation, arguing that allowing ICE agents to wear masks undermines public oversight and accountability. He stated, “Masks prevent transparency for citizens and hinder oversight.” He condemned the previous administration’s stricter immigration policies, asserting, “That’s Trump’s America, but that’s not the America we’ve grown up in. And so we are pushing back.”
California has been significantly impacted by the federal government’s immigration enforcement actions. According to DHS, approximately 5,000 immigrants living in the United States illegally were arrested in Los Angeles from June to August 2023 alone. This has created a charged atmosphere surrounding immigration policy in the state, where 27 percent of residents are foreign-born.
The conflicting stances of the DHS and California state government highlight the ongoing tensions between federal immigration enforcement and state-level policies aimed at protecting immigrant communities. Governor Newsom’s office has yet to respond to requests for comment regarding DHS’s refusal to comply with the mask ban.
